Terms of Service
1. Acceptance of terms
These Terms of Service ("Terms") form an agreement between you and Cargo-GO ("Cargo-GO", "we", "us"). By downloading, accessing, or using the Cargo-GO mobile application and related services (together, the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.
2. Eligibility
You must be old enough to form a binding contract in your jurisdiction to use the Service, and at least the minimum age required by the app store from which you obtained the application. If you use the Service on behalf of another person or an organization, you confirm you are authorized to accept these Terms for them.
3. Accounts and account responsibilities
Some features require an account. You agree to provide accurate information and to keep it current. You are responsible for activity that occurs under your account and for maintaining the confidentiality of any credentials or devices used to access it. Please contact us promptly if you believe your account has been used without your permission.
4. Description of the service
Cargo-GO is a luggage tracking and travel storytelling application. It is designed to help you record bags and trips, view status information associated with a journey, share selected trip information with people you choose, keep a record of past trips, and create digital postcards from completed journeys.
The Service presents information for convenience and general awareness. It is not a baggage handling service, a courier, an airline service, or an emergency service, and it does not take physical custody of your belongings.
5. Location and tracking-data limitations
You acknowledge and agree that:
- Status and location information may be estimated, delayed, incomplete, or unavailable.
- Information may depend on device permissions, network availability, device settings, and information supplied by third parties.
- The Service does not promise continuous, real-time, or precise positioning of any bag or item.
- You should not rely on the Service as the sole basis for time-sensitive, financial, safety, or travel decisions.
Where the Service indicates that information is estimated or that its source is limited, you agree to treat that indication as part of the information itself.
6. User-provided information
You may add information such as bag names, photographs, trip details, notes, and postcard content. You are responsible for that content and confirm you have the rights needed to provide it. You retain your rights in the content you provide, and you grant us a limited licence to host, store, process, and display it for the purpose of operating and supporting the Service.
7. Acceptable use
You agree not to:
- Use the Service to track a person, or any item, without the necessary rights or permissions.
- Use the Service for unlawful, harassing, deceptive, or infringing purposes.
- Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its systems.
- Upload malicious code, or content that is unlawful or violates the rights of others.
- Resell, sublicense, or commercially exploit the Service without our written permission.
8. Family and shared access
The Service allows you to share selected trip or bag information with other people. If you share access, you are choosing to disclose that information to the recipients, and you are responsible for deciding what to share and with whom. Recipients may be able to view the information you share for as long as the sharing remains active. You should review and revoke sharing when it is no longer needed.
9. Paid services and app-store purchases
Some features may be offered as paid one-time purchases or subscriptions. Where purchases are made through a third-party app store, that store processes the transaction, and its terms, billing rules, renewal behaviour, and refund policies apply. Subscriptions may renew automatically unless cancelled through the relevant app-store account settings before the end of the current period. Prices and offerings may change on a prospective basis.
10. Third-party services and data providers
The Service may rely on third-party platforms, infrastructure providers, and sources of travel or status information. We do not control those parties, and their availability, accuracy, and behaviour may change. Their services may be governed by their own terms and privacy policies. Nothing in the Service should be read as an endorsement by, affiliation with, or partnership with any third party unless expressly stated.
11. Intellectual property
The Service, including its software, design, text, graphics, and branding, is owned by Cargo-GO or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the application on devices you own or control. No other rights are granted.
12. Service availability
We aim to keep the Service available, but we do not promise uninterrupted or error-free operation. The Service may be unavailable during maintenance, updates, network problems, or events outside our reasonable control, and features may be added, changed, or removed over time.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
14. No guaranteed baggage recovery
Cargo-GO does not locate, retrieve, transport, or recover baggage, and does not guarantee that any bag or item will be found, returned, or delivered. Responsibility for baggage handling and for any claim relating to delayed, damaged, or missing baggage rests with the relevant carrier, handler, or other responsible party under their own terms and under applicable law. The Service may help you organize information, but it does not replace those processes.
15. Limitation of liability
To the fullest extent permitted by law, Cargo-GO and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, missed connections, travel costs, or other losses arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, our total aggregate liability relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or [INSERT AMOUNT].
16. Indemnification
You agree to indemnify and hold harmless Cargo-GO and its officers, employees, and suppliers from claims, damages, liabilities, and reasonable expenses arising from your use of the Service, your content, or your breach of these Terms or of applicable law.
17. Suspension and termination
You may stop using the Service at any time and may delete your account where that option is provided. We may suspend or terminate access if we reasonably believe these Terms have been breached, if required by law, or if necessary to protect the Service or its users. Provisions that by their nature should survive termination will survive.
18. Changes to the service
We may modify, suspend, or discontinue any part of the Service, including features that depend on third-party information. Where a change is significant and we are reasonably able to do so, we will aim to provide notice within the application or by other reasonable means.
19. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the effective date above. If a change is material, we will aim to provide additional notice. Continued use of the Service after an update takes effect means you accept the revised Terms.
20. Governing law
